Murder Charges in Spain: Aggravating Factors and the Risk of Permanent Imprisonment

Murder (asesinato) is the most serious offence under the Spanish Penal Code. Unlike homicide, murder requires at least one specific aggravating circumstance to be proven. When multiple factors are present, or when the case involves certain categories of victim, Spain’s harshest sentence — prisión permanente revisable (indeterminate permanent imprisonment) — comes into play.

What Makes a Killing Murder Rather Than Homicide?

Under Article 139 of the Spanish Penal Code, a homicide is elevated to murder when committed with: treachery (alevosia) — attacking when the victim cannot defend themselves; financial reward or promise; extraordinary brutality or cruelty (ensañamiento) — deliberately increasing the victim’s suffering; or facilitating another crime or concealing it. The baseline sentence for murder is 15–25 years imprisonment.

When Does Permanent Imprisonment Apply?

Prisión permanente revisable was introduced in Spain’s 2015 penal reform. It applies to murders involving: victims under 16 or particularly vulnerable persons; murder combined with a sexual offence; killing two or more people; killing a law enforcement officer or public official; or murder as part of a terrorist act or by a criminal organisation. Review of the sentence is possible after 25 years (35 years for terrorism), but is not automatic.

Defending a Murder Charge

The defence must attack the legal elements that elevate the charge. If treachery cannot be proven, the charge falls to homicide and the sentence range drops dramatically.
